The whole situation took place on 22 June. I went for a walk with my dog and we have met our neighbour, she is Polish like me. She used to visit me with her family, her kids were playing with my dog and he was never aggressive to anyone. My dog is NOT on the list of dangerous dogs in Ireland, so he doesn’t have to wear a muzzle. Apart from that, I kept the dog on a short leash. During a short conversation between me and my neighbour, my dog wanted to sniff a bag of crisps belonging to the neighbour, and because of that he got hit in the head. In this kind of situation, a dog to defend himself would run away, but my dog was on a short leash, so the only thing he could do to defend was to bite the neighbour. The woman has shaken the hand off the dog, it lasted maybe a few seconds.. She returned home and then went to medical care. She got a few stitches, so the wound was not serious. On the same day, around midnight, Gardai officers visited my house, their aggressive behaviour scared me and my son. They tried to take the dog off me, without any explanation. They DIDN’T even show me any documents proving that they have a warrant to take the dog and they didn’t want to give their names. I didn’t let them to take my dog. They took my phone number and while they were leaving, one of the officers was shouting that my dog ‘’will be put down ANYWAY’’. I was so frightened, not to mention how frightened was my child! I decided to save our beloved dog. A friend of mine took my dog to the person, who is experienced with dogs and has a few Akita dogs. It was a very difficult decision, but after I became familiar with the Irish Law on The Protection of Animals from 1911, I got to know that animals in Ireland have absolutely no rights! After 3 days, at around 11p.m., the same Gardai officer visited me again, he was looking for my dog at my house, AGAIN without any warrant or permission to search my house. After I told him, that my dog is out of town and out of county Carlow, he became aggressive, went out of my house, shouting that they will find my dog and put him down! I moved into new apartment, I was so frightened… I didn’t want to lose my beloved dog… but the worst was just to begin… After an article was published in the local newspaper, describing my dog as a bear killing breed and showing enlarged photos of the injured neighbour, describing that she almost lost her hand, I couldn’t believe my eyes… Then things went really fast- I have sent my son to my parents in Poland for a few weeks, so he doesn’t have to look at this situation. On 17 July, I was informed by a friend of mine that 109 Gardai officers were looking for me and my dog. I got a phone call that I have to go to the Gardai Office to resolve the matter. After arriving at the Gardai, the officer asked me where the dog was and I explained to him that my dog has a new home now, far beyond the county Carlow and that the dog is under supervision of and experienced dog owner. Once I told the story, I got arrested, they took my documents and informed me that the court hearing in my case in next day at 10.30 a.m. (ONLY 18 HOURS form me to prepare and defend myself !). Miraculously, I managed to contact one of the best solicitors in the county. We agreed to meet at 9 in the morning, just 1.5 hour before the court hearing. My case took place between 12-1p.m. The injured woman (my neighbour), her husband and the Gardai officer who visited me, were interviewed. All testimonials were like one big lie- my neighbour pretended that she and her family never visited me and never had contact with my dog. The Gardai officer testified that some time before the accident, his daughter got bitten, probably by the same dog. He described the dog to weight around 10kg, while my dog weights 45kg!! No one asked me… Because my solicitor had so little time to defend me, he referred to the list of dangerous dogs in Ireland, that my dog is not on the list, so he doesn’t have to wear a muzzle. The judge was not interested, the only thing he said was ‘’destroy the dog’’. My solicitor appealed to the Supreme Court straight away. I was totally devastated. To make long story short- I got arrested, officers were interwieving me for around 3 hours, my testimonials were not fully written down and they presented me five new charges, including physical assault on the victim, her personal property damage, taking a DANGEROUS dog for a walk without a muzzle and keeping him on a LONG leash, without a collar with his name attached. The three last charges only apply to the dogs listed on Dangerous Dogs in Ireland List from 1986 and my dog- AMERICAN Akita is not on the list ! I was immediately carried out to a specially organised hearing in court, my lawyer was present and Polish translator. The hearing took place without the presence of the public, as well as in the morning. It ended after about 1.5 hour. The decision was to arrest me and place me in one of the worst prison for women in Ireland. I was warned that the court has a break for a month (in August) so I will probably wait until September for the next hearing. They took me back to the Gardai Station, my personal things were taken away and I was placed in a cell with a mattress and a hole in the ground, which supposed to be my toilet! One of the officers told me that if I will say where the dog is, they release me. I had only one phone call, so I called my friend asking him to tell about the situation my family and friends, but not mentioning it to my child. I don’t know how long I was in the cell, crying, asking for a glass of water.. I wanted to go to the toilet, but the Gardai officer showed me the hole in the ground and turned off the light. I was sitting there without water, in 30degrees heat, I couldn’t eat… I was screaming and banging at the door, but no one reacted. After half an hour a lady officer gave me a glass of water and took me to the toilet. Then a friend of mine showed up, he told me that he had a private chat with the Gardai officer and the officer promised him that if I give the dog to the Gardai, the will release me, and the dog will be placed in the SPCA. I agreed, signed the documents and the exchange was done… The officer said good bye in Polish and smiled… I was taken by my friend to the nearest emergency room, they had to give me valium for a few days. I still could not sleep and eat. I’m in my home, but I don’t feel safe, I’m afraid the the situation will repeat and I will be arrested again. Next day, my friend took me to the vet, where my dog was held. The vet thought I was looking for a lost dog and he showed me the cages, I was shocked.. my dog was kept in a muzzle all the time, with no water at 30degrees heat ! I cried with my dog… But I was happy he is still alive! My friend recorded the whole situation with his phone. After a few minutes, the Gardai officers showed up, they were very aggressive, tried to lift me up! There were a few armed officers, they acted like I was a serial killer! I was said that I illegally went into private property, we tried to record it but one of the armed officers tried to take the phone off me, but I ran away, shocked, just to have a small bit of recording… My friend was talking with the inspector and asked him why he broke the promise, the inspector said that we should be happy, because the dog has not been shot yet …The vet came out and promised, that my dog will have food and water provided and in the evening my dog will be taken by the ISPCA… WHERE? I don’t know… I just want to save my dog, my part of the family ! I will do anything …. With the help of EMILIA KASTOR from Polish charity, we were able to find out that the dog was taken on Friday, by Gardai to the one of ISPCA places and is safe NOW… I am currently waiting for a hearing in the Supreme Court.
