Draft of the Prevention of Cruelty to Animals (Pet Shop) Rules, 2016 published for public comments, hence Naresh Kadyan, Abhishek Kadyan with Ms. Sukanya Berwal and People for Animals Haryana with OIPA in India submitting our observations: 1. Pet animals can't be treated as goods and commodity, restore five liberties with animal rights, as upheld by the Supreme Court of India, besides it Cow, Buffalo, Camel, Horse, Goat, Sheep, Donkey, Emu, Japanese Quails and poultry birds also needs in the definition of pet animals, likewise Cattle fairs also be pet shops 2. Exotic species also be protected under said Rules. 3. Offenses against said Rules should be cognizable, non-bailable with strong punishments because section 38 of the PCA Act, 1960 is a bailable and non cognizable offense in legal terms with minor punishments. 4. Mechanism for transportation and shifting of these pet animals should be clarified. 5. Traded pet animals needs to be registered with the Rural and Urban Authorities. 6. Exchange the custody of animals against payment should be covered under VAT and sales tax should be charged from the purchasers. 7. Feathers of birds should not be chopped and purchaser should have proper facility for treatment, care and shelter, abide section 3 of the PCA Act, 1960. 8. Indian Army / Police and Para Military forces are procuring animal and birds from the open market, such as pet shops and Cattle Fairs but these animals are exempted under PCA Act, 1960, so all these animals should be protected under law, rules and regulations for these animals and birds. 9. Retired, unproductive, old and disabled Pet animals should also be kept as per section 3 of the PCA Act, 1960, whereas Indian Army / Police and Para Military animals should be rewarded with pension and rehabilitation after retirement. The Chief State Commissioner along with the Commissioner (Head Quarters), Haryana Scouts and Guides also endorsed the above said observations, keeping in view the article 51 A (g) of Indian Constitution read with the mandate of the Bharat Scouts and Guides.
