We need tougher laws for those who commit any form of animal abuse

BUFFALO, N.Y. Authorities believe someone sprayed a 16-week-old Jack Russell Terrier with lighter fluid before setting it on fire.The dog was found on Herman Street on Buffalo's east side by a neighbor. Firefighters wrapped it up in a blanket and brought the puppy ...to the Buffalo Small Animal Hospital around 5:30 p.m. Monday.
Its hair is singed, its lips are swollen, and it struggles to keep its puffy eyes open. Doctors say the next five to seven days will be critical in the dog's recovery.
Dr. Rebecca Wagner, who treated the unnamed puppy, questioned, "How could somebody do this? It's just a terrible, terrible situation. Hopefully he'll make it."
The puppy sat quietly Tuesday. Doctors say he may still be in shock. He's being pumped full of fluids and pain killers after suffering burns all over his body. The dog's ears are "crinkled" according to Dr. Wagner, who said she believes lighter fluid was used to set the puppy ablaze.
"It had a smell to it, an odor to it. And the dog was singed really from head to toe," she said.
The dog has third degree burns across 30 percent of its body. Dr. Wagner says this is one of the worst cases she's seen. But she's hopeful the puppy will pull through and be adopted.

AB 269, sponsored by Assembly Member Amy Paulin, and S 1853, introduced by state Sen. Suzi Oppenheimer, would make a second offense within 5 years for animal cruelty under NY CLS Agr. & M. Sec. 353, a Class E felony. The second offense would be punishable the same as an act of aggravated animal cruelty or torture under NY CLS Agr & M Sec. 353-a, up to 2 years in prison. Currently, animal cruelty other than aggravated animal cruelty, is punishable as a misdemeanor no matter how many times the perpetrator commits it. Aggravated animal cruelty is defined as "conduct which: (i) is intended to cause extreme physical pain; or (ii) is done or carried out in an especially depraved or sadistic manner". The statute protects only companion animals. Aggravated animal cruelty, as defined, is difficult to prove.
Neither this bill nor any of the pending bills would address the problem of proving someone "intended" to cause "extreme physical pain" as opposed simply to any unjustifiable pain or recklessly causing pain. It is also difficult to establish abuse was caused in "an especially depraved or sadistic" manner. To improve enforcement of animal cruelty laws, along with the increased penalties, it would be important to relax the burden of proof and include all animals within the protections of this law.
These current punishments are not harsh enough. Let's work together and let our voices be the voice of those who cannot speak.
