Petition to Demonstrate Opposition to Proposed Shelbourne Assisted Living Facility

We, the Residents of Greenburgh, NY, believe that the proposed use of the Sprainbrook Nursery land for an 80 unit 94-bed assisted living facility, which is more than a mile from where such facilities in residential neighborhoods in unincorporated Greenburgh are legally permitted under the Town's zoning law (the law requires it be within 200 feet of Central Avenue) infringes on our rights under that law, which was expressly adopted specifically to protect residents in residential neighborhoods such as ours from the noise and traffic associated with emergency medical calls to facilities such as these.

Placing such a facility at that location is estimated to generate 100+ incremental emergency vehicle response incidents annually. The fire district and the police chief and the planning commissioner have access to data that may well support that this represents a substantial increase over the current use of emergency vehicles (with lights and sirens) running through our neighborhood. This would also impact the service levels of other incidents elsewhere in the neighborhood.

The Town should also follow the fire district's recommendation that the Town hire an independent consultant to study whether these 100+ emergency incidents will also increase the risk of accidents at the dangerous downward sloping hairpin curve on Underhill Road just before the Sprainbrook site and whether any approvals should be conditioned on a satisfactory mitigation plan being implemented.

The Town should not move forward on any approvals of this project without gathering this data and considering the analysis independently.

My name is Jeffrey Sherwin and my family and I live on 3 Oxford lane which is just off Underhill road, and we have recently purchased 367 Evandale Road, which is another property just off Underhill.


Please accept this petition in opposition to the granting of the variances being requested.

Dear Petition Signers,

Tomorrow evening there will be zoning board meeting to discuss whether or not to grant the variance for this facility. The meeting will be held at the Greenburgh Town Hall on June 16th at 8pm. Please join me there. Even if you don't speak, your presence and applause is a clear signal to the zoning board on this matter.
