Sex-Based Discrimination Could Skyrocket After This Supreme Court Case

The Supreme Court has just signaled a terrifying shift in its approach to sex-based discrimination. During oral arguments for United States v. Skrmetti in December 2024, several justices expressed support for allowing laws that explicitly discriminate against individuals based on their sex assigned at birth.

This case centers on Tennessee's cruel ban on gender-affirming care for trans youth - and as an extension, generally on medical care based on sex. Its implications could extend beyond attacking trans rights - it could also undermine decades of hard-fought protections for everyone else too, including for cis women.

Your voice is powerful. Add your name to the petition, demand that state governments codify equal rights into law and take a stand against hate and discrimination.

Justice Ketanji Brown Jackson herself expressed deep concern, saying she was "suddenly quite worried" about where this Court may be headed. If the justices carve out medical exceptions to longstanding protections against sex-based discrimination, it could open the door to attacks on countless rights - from reproductive freedom and healthcare privacy, to LGBTQ+ equality, and more.

This is not just about one state law. This is a full-scale assault on the very foundation of equal rights in the U.S. Laws that target trans individuals are rooted in the same discriminatory logic used to oppress women, people of color, and other marginalized groups throughout history. If we don't act now, the Court's decision could set a devastating precedent that affects us all.

The Court will release its final opinion in mid-2025. But we cannot just sit around idly, waiting to see what the Court decides.

State governments must step up immediately to protect their residents from sex-based discrimination, whether they are cisgender, transgender, or nonbinary. We need robust state laws to ensure no one faces discrimination because of who they are. Sign the petition now!
