PENTRU PACE SI STABILITATE IN REPUBLICA MOLDOVA SI EUROPA!
Noi subsemnam Manifestul Democratic al ACUM in cerinta si sutinerea celor 4 actiuni ale acestei Petitii.  In special cerem reorganizarea alegerilor Parlamentare in Republica Moldova si facilitarea participarii la vot fara discriminare pentru toti cetatenii Republicii Moldova emigrati peste hotare.
Am citit petitia extinsa in limba Romana, mai jos.

We co-sign the Democratic Manifest of ACUM and support the 4 actions proposed by this Petition. We especially request the reorganisation of Parliamentary elections in Republic of Moldova and support to allow all citizens of Republic of Moldova who emigrated abroad to vote without discrimination.

Dragi Concetateni,

Mult stimati Domni si Doamne,

si Respectabile Institutii locale si internationale, politice si apolitice,

MANIFEST DEMOCRATIC ACUM, PENTRU ALEGERI PARLAMENTARE REPETATE CORECT SI LIBERE PENTRU REPUBLICA MOLDOVA

in acord cu membrii Asociatiei Comunitatilor Unite ale Moldovei %u2013 ACUM,

CONSTUTUITA la 7 Martie 2009 si confirmata prin intregistrare la Londra si Bruxelles, ce lucreaza pentru a promova si contribui la promovarea, sustinerea, protejarea si re- /integrarea cetatenilor Republicii Moldova (RM) in procesele economice, sociale, politice si culturale din Republica Moldova (RM) si statele gazda;

in acord cu semnatarii acestui document,

PE BAZA LEGALA SI JURIDICA A:

·        CONSTITUTIEI REPUBLICII MOLDOVA, si anume Titlul privind Drepturile, Libertatile si Indatoririle Fundamentale: Articolul 15 Universalitatea Constitutiei; Articolul 16 Egalitatea concetatenilor RM si obligativitatea ocrotirii de Stat; Articlolul 18 Protectia cetatenilor RM;  Articolul 20 Accesul liber la Justitie; precum si

·        ARTICOLULUI 38 (A) %u2013 Dreptul la vot in mod periodic prin sufragiu universal, egal, direct, secret si liber exprimat in Constitutia RM; precum si

·        Declaratia Universala a Drepturilor Omului (UNDHR), si anume Articolul 6 Recunoasterea universala a persoanei; Articolul 21 Dreptul la vot; si Articolul 28 Dreptul pentru facilitare internationala; precum si

·        Conventia  Europeanã  a Drepturilor Omului (ECHR), si anume Articolul 10 Dreptul la Exprimare si alegere; si Articolul 13 Jurisdictia ECHR in Republica Moldova; precum si

·        Conventia Internationalã a Drepturilor Civile si Politice (ICCPR), si anume Articolul 16 Recunoasterea universala a persoanei; Articolul 26 Egalitatea in fata legii; si Articolul 25 Dreptul la vot si participare la viata social-politica; Articolul 27 Dreptul la limba, religie si cultura;  precum si pe baza

·        Conventia Internationalã a Drepturilor Sociale, Economice si Culturale (ICESC)

DECLARAM, si MANIFESTAM:

Regretul ca oficial cel putin peste 500,000 de concetateni cu rezidenta inregistrata peste hotare, nu au putut avea acces la urnele de vot. La  putinele sectii de votare de peste hotare, s-a refuzat exercitarea votului de cetatean cu prezentarea buletinului de identitate. Multor cetateni nu li s-a permis sa intre in tara, de peste hotare. Deasemenea in pofida absentei multor cetateni aflati peste hotare de la sectiile de votare din Moldova, datele lor de residenta au fost folosite pentru fraudare de partidul de cenzura si putere din Republica Moldova.    

Sute de mii de cetatenii aflati in Moldova si in afara tarii au demonstrat prin petitii si manifestari publice pasnice ca nu accepta rezultatele alegerilor din 5 Aprilie si nici investigatiile  regimului de cenzura din Republica Moldova.  La alegerile din 5 Aprilie 2009 s-au negat existenta si drepturile de cetatean la cel putin un million de oameni.

Suntem alarmati de negarea dreptului Constitutional si a legii RM privind alegerea Parlamentului ce trebuie sa serveasca vointa poporului. Noi, miile de concetateni prezenti la putinele urne de la sectiile de vot de peste hotare am fost supusi discriminãrii directe si exclusi de la exercitarea dreptului elementar de cetatean.  In pofida cererii noastre primite de Comisia Electorala Centrala (CEC) din Decembrie 2008, hotarirea anti-constitutionala nr. 2213 a CEC din 27 Februarie 2009, nu a prevazut votarea pe baza buletinelor de indentitate, ce de altfel sunt cele mai incontestabile mijloace de a impiedica frauda electoralã. Absenta impusa sta la baza fraudei electorale repetate de partidul Comunistilor in anii precedenti. Pe baza acestor omiteri si incalcari premeditate, alegerile din 5 Aprilie sunt inefective.

Clasa politica a actualului regim anti-democratic a ignorat si continua sa ignore si sa nege vointa cetatenilor de peste hotare, care constituie baza economica, sociala si diplomatica ce salveaza tara de la prabusirea totala. Sub mana fortelor de ordine si politie, in Moldova zilnic au fost arestati si torturati sute de oameni, si chiar comise omoruri pentru a inabusi orice revolta. In Republica Moldova nu mai functioneaza un Stat de drept ci un regim de tip mafiot care anihileaza orice opozitie. Inchiderea si blocarea mediilor de informare si de comunicare alternative posturilor de derutare si spalare a mintii controlate de actualul regim sunt semne evidente de intimidare si abuz. Persecutia, santajul, amenintari, defaimari, acuzatii false sunt sistematic folosite de Comunisti si de regim pentru a mentine dictatura. Impunerea regimului de vize pentru Romania, precum si restrictionarea de la functiile publice de Stat a cetatenilor Moldoveni ce si-au redobindit cetatenia Romana sunt niste masuri de excludere a sute de mii de cetateni Moldoveni, si chiar milione de cetateni din Republica Moldova ce sunt etnici Romani. Acuzatiile neintemeiate impotriva Romaniei au ca scop izolarea Romaniei de Republica Moldova si provocarea unei instabilitati nationale si regionale.

Atat pe baza Constitutiei, cat si a Conventiilor Internationale pentru Drepturile Omului, Asociatia Comunitatilor Unite ale Moldovei si subsemnatii cetateni si sprijinitori         NU PUTEM RECUNOASTE ALEGERILE PARLAMENTARE din 5 Aprilie 2009.

• Diaspora cere tuturor partidelor cu orientare democratica, sa nu treaca cu vederea peste un milion de concetateni emigrati ai Republicii Moldova. Prezentam o forta reala si vom actiona sa iesim din batjocura si durere. Nu vrem sa mai fim exclusi.
• Suntem acuzati de ilegalitate si de lipsa de patriotism, desi munca si banii nostri alcatuiesc cea mai insemnatã contributie la mentinerea tarii pe linia de existenta.
• Ni se respinge participarea la luarea deciziilor. Suntem vii, dar cum sa participam ca cetateni daca ni se refuza exercitarea drepturilor umane si Constitutionale?
• Nu putem reveni acasa, dar ne umplem de durere pentru cei ramasi in Moldova.
• Republica Moldova este acum o tara fara jumate din populatie, care a emigrat in preponderenta in Uniunea Europeana. 
• Cele doua resurse ale Moldovei %u2013 pamantul si oamenii %u2013 sunt separate si trebuie reunite pentru a activa tranzitia.

Noi vrem o altfel de viata si a venit momentul sa o avem acasa.

PENTRU MOTIVELE EXPUSE CEREM URMATOARELE ACTIUNI:                                                                                                                       pentru securitatea nationala si regionala,

1.      Anularea rezultatelor alegerilor din 5 Aprilie ce au fost Anti-Constitutionale, falsificate si nereprezentative pe plan international, si reorganizarea altor alegeri libere si democratice;

2.      Incetarea: violentelor politiei, a cenzurii si blocajelor telemedia, si a folosirii armatei impotriva poporului si protestatarilor pasnici;

3.      Schimbarea hotaririi CEC cu nr. 2213 din 27 Februarie 2009, pentru ca cetatenii aflati peste hotare sa poata vota exact pe baza acelorasi acte de identitate ca si cetatenii aflati in Republica Moldova, si la sectii usor accesibile.

4.      Anularea regimului de vize pentru cetatenii Moldovei sa intre in Romania si vice-versa, si negocierea unui acord de calatorie fara vize in Uniunea Europeana pentru cetatenii Republicii Moldova. 

MAI ATENTIONAM:                                                                                                            ca nerespectarea acestor declaratii si revendicari duce la:

1. Incalcarea Constitutiei si a tuturor Conventiilor Internationale pentru Drepturile Omului la care a aderat Moldova;
2. Neconstitutionalitatea Parlamentlui si Statului;
3. Ilegalitatea activitatii de Stat a Republicii Molodva;
4. Revolte continue si instabilitate militar-politica in Moldova;
5. Intensificarea emigratiei si pierderea dorintei de repatriere;
6. Embargoul financiar al diasporei, cu agravarea consecutivã a crizei economice si social-politice.                                                                                                                        

Avem nevoie imediata de mediatizarea acestei Petitii la posturile si agentiile de mass-media locale si internationale, si de sustinerea tuturor agentiilor guvernamentale si inter-guvernamentale si a societatii civile din Europa si de oriunde in lume.

Respectable local and international Institutions, political and apolitical,

DEMOCRATIC MANIFEST FOR RERUN OF PARLIAMENTARY ELECTIONS

FOR REPUBLIC OF MOLDOVA

in accord with the Association of the United Communities of Moldova %u2013 ACUM, officially established on 7th of March 2009 and confirmed by registration in London and Brussels %u2013 that works promoting and contributing to the promotion, support, protection and re-integration of the citizens of the Republic of Moldova (RM) into economic, political, social and cultural processes in Moldova and the host countries;

in agreement with the signatories of this document,

PURSUANT TO THE LEGAL BINDING POWER of:

·        THE CONSTITUTION OF THE REPUBLIC OF MOLDOVA, namely Title related to the Fundamental Rights, Liberties and Duties: Article 15 The Universality of the Constitution; Article 16 The Equality of the Moldovan citizens and the compulsory character of state protection; Article 18 The Protection of the Citizens of the Republic of Moldova;  Article 20 Free Access to Justice; as well as

·        ARTICLE 38 (A) %u2013 the right to periodically vote by universal, equal, direct, secret and free ballot-casting,  enshrined in the Constitution of RM; and

·        The Universal Declaration of Human Rights (UNDHR), namely Article 6 The Universal Recognition of the Person; Article 21 The Right to Vote; and Article 28 The right to International Facilitation; as well as

·        The European Convention For Human Rights (ECHR), namely Article 10 The Right to Expression and Election; and Article 13 The Jurisdiction of ECHR in the Republic of Moldova; as well as

·        International Covenant for Civil and Political rights (ICCPR), namely Article 16 The Universal Recognition of the Person; Article 26 Equality before the Law; and Article 25 The Right to Vote and Participate in the Social-Political Life; Article 27 The Right to Language, Religion and Culture;  as well as in compliance with

·        The International Covenant for Social, Economic and Cultural Rights (ICESC)

WE STATE AND DEMONSTRATE:

Our regret that officially over 500,000 of Moldova%u2019s citizens residing legally abroad had no access to the ballot boxes. At the few voting offices scarcely available, hundred of thousands of citizens were refused the right to exercise their vote with their National ID cards. Many citizens were refused entry to Moldova from abroad to vote on the elections day. Also, in spite of many citizens being absent and not attending local voting offices in Moldova, their private data and residential details have been used by the regime in power to commit fraud.   

Hundred of thousands of citizens located abroad and in the Republic of Moldova have demonstrated through petitions and peaceful public manifestations that they do not accept the results of the elections of 5 of April and neither the investigations of the current regime of censorship in Republic of Moldova.  At the elections on 5 of April 2009, over one million citizens were negated their existence and citizen rights.

We are alarmed by the denial of the Constitution and law of the Republic of Moldova, and the imposition of a dictatorial regime. Thousands of Moldovan citizens who attended the ballot boxes abroad were discriminated and denied the basic Constitutional Right to vote.  In spite of our petition received by the Central Electoral Commission (CEC) in December 2008, the anti-constitutional decision nr. 2213 of CEC from 27 of February 2009, did not allow the voting abroad with the national ID cards which are in fact the incontestable documents preventing electoral fraud. The denial and absence imposed stand at the base for the frauds that the Communist Party repeats as in previous years. Based on these omissions and criminal infringements the elections of 5 of April are ineffective.

The political class of the current anti-democratic regime has ignored and continues to deny the requests of the Moldovan citizens living abroad, in spite of their foremost economical, diplomatic and social contribution that saves the country from total collapse.

The police and order forces have arrested and tortured hundreds of people and murders were committed to discontinue any revolts. The Rule of Law ceased to function in Republic of Moldova and the mafia-style Communist regime annihilates now any opposition. The closure and blockade of the information and communication Medias which are alternative to the few brain-washing posts controlled by the current regime are ever evident signs of intimidation and abuse. Persecution, blackmail, threats, defamation, false accusations are systematically used by the Communists and the current regime to prolong the dictatorship. The imposition of a visa regime for Romania, but also the restrictions against the Moldovan citizens who also regained the Romanian citizenship to hold public functions in the State, are made to exclude hundred of thousands of Moldovan citizens, and nonetheless millions of citizens from the Republic of Moldova who are ethnic Romanians. The unjustified accusations against Romania have as purpose to isolate Romania from Republic of Moldova and provoke a national and regional instability.

Based on the Constitution of Republic of Moldova and on the International Conventions for Human Rights the signatories and supporters of this Petition

CAN NOT AND DO NOT RECOGNISE THE ELECTIONS of 5th of April 2009.

• The Diaspora requests the political parties with democratic perspectives, not to neglect the over one million Moldovan citizens who are living outside the Republic of Moldova. We are a real force and can act to put an end to our pain and humiliation. We are alive and do not want to be excluded anymore.
• We are being accused of illegality and lack of citizenship, although our money from hard work contributes mostly to keeping the country afloat.
• We are ignored and denied in decision-taking.  How can we act as citizens when we cannot exercise our human and Constitutional rights?

·         Now, we can not return home, but feel pain for the remaining people in Moldova.

·         Republic of Moldova is now a country missing almost half of its population who had emigrated mostly in the European Union. 

·         Moldova%u2019s main resources %u2013 land and people %u2013 are separated, and until rejoined cannot effect country%u2019s transition.

We want another life and now it is time to have it home.

FOR THE REASONS ABOVE WE REQUEST THE FOLLOWING ACTIONS:                                                                     
for security in Moldova and Europe

1.      Revoking the results of 5 of April elections in Moldova which have been Anti-constitutional, falsified and unrepresentative, and reorganization of free and democratic elections;

2.      Stopping: Police violence, Tele-media blockages and censorship, and military and state forces engagement against any peaceful protesters;

3.      Amendment of the CEC instruction nr. 2213 for citizens from abroad to be able and vote exactly with the same documents as the citizens located in the Republic of Moldova, and at premises easily accessible where they reside in big numbers.   

4.      Canceling the visa regimes for the citizens of Moldova to enter Romania and vice-versa, and negotiation of an agreement to travel without visas in the European Union for the citizens of Republic of Moldova.

WE DRAW ATTENTION:                                                                                                        that ignoring and non-fulfilling these requests lead to:

1. Breach of ALL International Conventions for Human Rights to which Moldova is a party and the Constitution of Republic of Moldova;
2. Non-constitutionality of the Parliament and the State in Republic of Moldova;
3. Illegality of the State activity in the Republic of Moldova;
4. Permanent riots and general instability in the Republic of Moldova, and abroad;
5. Growth of emigration and the loss of the desire of emigrants to return to Moldova;
6. Financial embargo of the Diaspora, with the worsening of the social politic and economical crisis.

We need the publicity of this Petition in the local and international mass-media outlets, and the support of governmental and inter-governmental agencies and of the civil society in the European Union and anywhere in the world.
