The Supreme Court has just signaled a terrifying shift in its approach to sex-based discrimination. During oral arguments for United States v. Skrmetti in December 2024, several justices expressed support for allowing laws that explicitly discriminate against individuals based on their sex assigned at birth.

This case centers on Tennessee's cruel ban on gender-affirming care for trans youth - and as an extension, generally on medical care based on sex. Its implications could extend beyond attacking trans rights - it could also undermine decades of hard-fought protections for everyone else too, including for cis women.
