It is with grave concern and great urgency that We the Undersigned request the immediate and unconditional release of Maryam Rostampour and Marzieh Esmaeilabad. Both were arrested on March 5, 2009. Both are being held without charge in Tehran's Evin Prison.
Article 23 of the Iranian Constitution states: The investigation of individuals' beliefs is forbidden, and no one may be molested or taken to task simply for holding a certain belief. Article 18 (1) of the International Covenant on Civil and Political Rights (ICCPR), to which Iran is a state party, states: Everyone shall have the right to freedom of thought, conscience and religion. This right shall include freedom to have or to adopt a religion or belief of his choice, and freedom, either individually or in community with others and in public or private, to manifest his religion or belief in worship, observance, practice and teaching.
If they have been arrested on charges other than solely on account of their religious beliefs, promptly charge them with a recognizably criminal offense and try them is fair proceedings. In such case, we call for them to be granted immediate and unconditional access to a lawyer. We further call for any medical treatment they require. Further we call for the Iranian authorities to ensure that they are not being tortured or ill-treated while in detention.
