Adopt an Effective Noise Ordinance in the Town Of Colonie, NY

At present, the noise ordinance in the town code of the Town of Colonie allows for noise levels that effectively threatens the health and welfare of its citizens. 

The Colonie Town code currently prohibits "Any noise which, when measured by a sound level meter at the property line of the parcel from which it is emanating or at a distance of 20 feet if it is emanating from something or someone on a street, is in excess of 75 db between the hours of 11:00 p.m. and 7:00 a.m."

We petition the Colonie Town Board to immediately consider the adoption of a revised noise ordinance modeled in part after the ordinance adopted by New York City, that would eliminate the decibel standard for noise emanating from bars, nightclubs, restaurants, and motor vehicles.  Instead, the new ordinance should apply the "plainly audible" and "unreasonable noise" standards, as specified in the Nw York City code, below.

Personal audio devices.  (a)  No person shall operate or use or cause to be operated or used any personal audio device in such a manner as to create an unreasonable noise.

 (b)  For the purposes of this section unreasonable noise shall include but shall not be limited to: 

(1) the operation or use of a personal audio device on or in any public right-of-way so that sound emanating from such device is plainly audible to another individual at a distance of 25 feet or more from the source.
