Segway use in New York City

Due to complaints of powered scooters the NYC Council has pending bills which will ban the use, sale, lease, of Segways for abled and disabled persons in public or private. We petition NYC not to define the Segway as a motorized scooter and to give Segway a chance as have 41 other states.
Due to numerous complaints about gasoline powered scooters by concerned residents, the city council is preparing Bill 98, 37 and 86, which will ban the public or private use of the Segway Human, transport in New York City.
Wherefore I petition the New York City Council
1. The Segway transport is not a motorized scooter as defined in this legislation. It is based on new technology, which has proven itself to be safe and reliable.
2. The Segway is not an issue of public safety as in the Metro area of over 8 million people. There are less than 150 Segway owners in the NY metropolitan area, with no reported injuries from Segway use.
3. The Segway will provide the future with the opportunity to embrace this new technology, and can be part of the solution to our transportation congestion and environmental problems.
4. A ban will negate any advancement of transportation technology in our congested environment, and opportunities for testing, evaluation and registration and regulation will be lost.
5. A ban will preclude the use by the disabled and mobility impaired population. The Segway offers these people mobility opportunities than many of them felt they had forever lost.
6. In bill 98,37,86 and all other legislation the definition of a motorized scooter will be amended to not include the Segway and the exclusion for disable use amended to read, "for the purposes of this section, the term motorized scooter shall not include wheelchairs or other mobility aids used by person (s) with a mobility impairment as defined under the American's with Disabilities Act"
7. The Segway is classified as an EPAMD (an electric personal assistive mobility device), a self-balancing, nontandem two wheeled device, that can turn in place, designed to transport only one person, with an electric propulsion
system averaging less than 750 watts (1 hp), the maximum speed of which, when powered solely by a propulsion system on a paved level surface is less than 12.5 mile per hour"


8. We urge the New York City Council to work with the New York State Assembly to pass positive legislation for use of the Segway in New York City and State,
9. To provide hearings and commission reports based on research into the actual performance characteristics and safety record of the Segway prior to any proposed legislative action, which would restrict or ban the Segway Human Transporter. To institute a ban without such research is prejudicial, contrary to due process,
Please give the Segway a chance, as 41 other States have to make its contribution in alleviating NYC's ongoing transportation and traffic crisis.
