NOW, THAT DETENTIONS AT GUANTANAMO BAY%uFFFDARE COMING TO AN%uFFFDEND,%uFFFDit is time to apply the same standards at home - here - in L.A. Here - where the number of those who are confirmed falsely imprisoned is estimated at 10,000 - those who were never released in the past decade in disregard of the outcomes of the Rampart scandal investigations (98-00) and successive review panel reports since then. %uFFFDThe blight of government in L.A. County, California, the most populous in the U.S., is visible also in large scale abuses of the civil rights of all the 10 millions who live here; in an ineffective U.S.-appointed Overseer for civil rights; in the emergence of the sub-prime crisis -with L.A.-based Countrywide at its center; in the deliberately aimless FBI investigation of Countrywide; in the failure of efforts to enforce Countrywide's compliance as part of the bailout; in a wave of foreclosures that leads to the looting of homeowners everywhere, and in widespread corruption at the LA courts on a scale unheard of elsewhere in the U.S.%uFFFDThese are problems that must be addressed by the U.S. government.

We call upon President Obama to appoint a SPECIAL COUNSEL to restore the public's right of access to the public's records at the courts. it is a minimal gesture, demonstrating his administration's stand on "equal protection", and civil rights at home.

We call upon human rights organizations everywhere to study conditions prevailing in L.A. and to send observers here to examine the conduct of both local and U.S. agencies. %uFFFDSuch organizations ought to do so for their own benefit. %uFFFDBecause the impact of what took place here in the past quarter century, is now felt world-wide. %uFFFDHere they will also be able to study corruption and forms of abuse that are yet to be conceived in most other places.

The restoration of public access to the public's records at the%uFFFDcourts will empower the public and civil rights organizations, it will lead to restoration of integrity of the courts by disabling much of the wrongdoing at the L.A. courts, it will allow the public to review the track records of the judges, %uFFFDit will allow effective use of large scale writs of habeas corpus to release those who are falsely imprisoned, and it will allow the office of Overseer and the FBI in LA to effectively perform their duties..In%uFFFDNixon v. Warner Communications, Inc., 435 U.S. 589 (1978), the U.S. Supreme Court affirmed %uFFFD"the common-law right of access to judicial records" otherwise referred to as "the common-law right to inspect and copy judicial records". %uFFFDAnd yet, for the past quarter century, the LA Courts have declared (but never published) a rule that their quintessential records were "privileged - for the Courts only", in entire disregard of the law..Where did the courts find the authority to impose such a "privileged" state on the public's records held by the court for safekeeping? %uFFFDIt was never spelled out, because there wasn't, there isn't, and there never will be a just reason for an honest court to conceal the public's records from the public. %uFFFD.And how were such records treated, while they were sequestered for a quarter century in such a "privileged" state? %uFFFDWe are yet to find out, but existing evidence does not bode well...

WE THE UNDERSIGNED APPEAL TO PRESIDENT BARACK OBAMA AND HUMAN RIGHTS SUPPORTERS EVERYWHERE:

We congratulate President Obama for his decision, and all those who joined in efforts to bring the detentions at Guantanamo Bay to an end. Now it is time to apply the same standards at home - in LA, where the number of the falsely imprisoned people is estimated at 10,000. Such figure includes only those whose cases were shown in Rampart investigations, a decade ago, to be based on framing or confessions extracted through torture, and are also likely to be racially biased, reflecting conduct typical of "repressive dictatorships", and a disgrace of historic proportions.

President Obama -- if you allow it to stay -- you will own it!

Large scale abuses of civil rights in LA were recognized already a decade ago, but the Overseer appointed in 2001, is ineffective. Countrywide, which led this country into the sub-prime debacle is based here as well, and Countrywide's much publicized investigation by the FBI must be deemed deliberately aimless, while the company is still far from compliance, while the waive of foreclosures is growing, leading to looting of homeowners everywhere. %uFFFDAt the bottom of it all, is widespread corruption of the LA Superior Court, overlooked for decades, crippling government and tainting the social fabric here.

These problems can and must be effectively addressed at the federal level with a simple measure: A SPECIAL COUNSEL TO IMMEDIATELY RESTORE THE RIGHTS OF ACCESS TO PUBLIC COURT RECORDS.

Abuse of such rights for the past quarter century by the LA courts is a disgrace on its own. Restoring public access will empower the public, disable wrongdoing at the courts, flag judges that need to be noticed, and allow civil rights organizations to end the false imprisonments through large scale writs of Habeas Corpus. We hope it will make the LA Overseer, crippled by denial of access to records, more effective as well. Finally -- by eliminating the FBI's inexplicable preoccupation in covering up court corruption -- we hope it will allow the FBI to focus on performing its duties and assume an effective role in restoring the integrity of financial institutions.

HUMAN RIGHTS SUPPORTERS: PLEASE ENCOURAGE HUMAN RIGHTS ORGANIZATION EVERYWHERE TO FOCUS ON CONDITIONS HERE, IN L.A., WHERE IN THE PAST DECADE THE U.S. GOVERNMENT, THE U.S. DEPARTMENT OF JUSTICE, AND THE FBI, ABANDONED ANY PRETENSE OF PROTECTING THE RIGHTS "GUARANTEED" IN THE AMENDMENTS TO THE U.S. CONSTITUTION.
