The most important that parents don't consider a crime what was made by their children. This and similar tragedies happen only for one reason - indifference of adults. How many people saw cruelty of children in relation to animals and passed by, were silent, being afraid to report in law enforcement agencies.
Concerning children the question of initiation of legal proceedings, but as they didn't reach age of criminal liability, initiation of proceedings it will be refused is raised.
Concerning parents protocols, but already about an administrative offense are constituted too. Here only the amount of a penalty it is insignificant it is small - will pay only 500 rubles (about $7,5) for promotion of cruelty of the children of their mother and father
But the most terrible that publicity and criminal article didn't stop little fleecers:
How mockery and murder of kittens became known, and law enforcement officers and inspectors of PDN communicated to children (division for minors), near houses found the disfigured corpses of animals again, the administrator of the "Help to Animals of the City of Balakovo" group Lyudmila Nabilkina told.

And it is not the complete list of the atrocities which underwent to publicity, among them there are partitions, scrapings, mutilation, beating and murders.
To live in society, infected with zoophobia and supporting zoofascists, it became unimaginably heavy and unsafe. Along with the fact that at society there is a resistant hostility to the people trying to solve a problem of homeless animals cases of attacks and persecution of these people became frequent. And those who have sadistic bents everywhere openly and provocatively show them, propagandizes. Causing support of many:
Cruelty in relation to animals and, as a result, to people, assumed the societies menacing for existence a scale because remains absolutely unpunished in connection with a gap in the legislation.
There are these tragedies for the following reasons:
1) Total indifference from the Government of the Russian Federation:

To recognize the crimes described regarding the second article 245 Criminal Code of the Russian Federation having heavy structure and to enter custodial sanction for a period of five up to ten years. Animals aren't either persons of law, or participants of the public relations in this connection operation of the law can't extend to them.
To expel from group of companies the status of a thing for animals. To recognize them live. To determine the status of an animal legislatively as living being on whom pain and suffering owing to mockery at it are inflicted.
1. to join the international convention about protection of animals;
2. to adopt the marine life protection act of animals developed by NPO "Center of protection of the rights of animals" of Vit" as the most comprehensive and competent version of the bill;
3. to actively apply the provision of the law regarding protection of animals (. St 245 Criminal Code of the Russian Federation (in the toughened option)) in relation to those who scoff at animals or leave them in the conditions threatening health and animal life (further understanding special social danger of such "people" to the society, to toughen punishment under this article up to real terms of the conclusion.);
4. to enter article forbidding occupation begging with use of animals into the Criminal Code of the Russian Federation.
5. to enter the aid program into sterilizations of animals at the expense of the funds allocated at present for daily shooting and poisoning of animals - the partners who became with "help" of the former owners by the homeless;
6. to open in each residential (district) location homeless animals shelters, with obligatory participation in their work of the zooprotective organizations and volunteers - volunteers.
7. To level promotion of destruction of animals to extremism, and dogs hunters/poachers/fleecers to terrorists in relation to fauna.
Третьеклассники г. Балаково, Саратовской области изнасиловали, а затем отрубили лапы и головы котятам, которых подкармливал весь дом.
Перед тем как убить животных, 9 и мальчики 10 лет надругались над ними. В отношении детей возбудили уголовное дело, но так как оба младше 16 лет - его закроют.

Целую многоэтажку в Балаково держит в страхе десятилетний ребёнок. Школьник и его друг помладше, 9 лет которому, зверски замучили котят, которых подкармливали местные всем двором. А после случившегося ... только три человека из трех домов, ставших свидетелями жестокости детей, поставили подписи в заявлении в полицию. ОСТАЛЬНЫЕ ИСПУГАЛИСЬ, что третьеклассник им будет мстить.
Оказалось, многие действительно видели, как школьники убивали животных. Одна из свидетелей три недели спустя рассказала о ЧП подруге , а та написала пост в интернете:
Следователи и комиссия по делам несовершеннолетних начали проверку, рассказала Людмила Савочкина, заместитель главы администрации Балаковского муниципального района по социальным вопросам
Удалось Установить, что школьники отрубили котятам лапы и смотрели, как животные будут ползти. Потом отрубили головы и приклеили их скотчем. При этом другие дети пытались им помешать, кричали, но мальчиков это не остановило.
Оказалось, что этого маленьким живодерам было мало. Волонтерам общества помощи животным г. Балаково жительница этого дома рассказала, что над котятами перед смертью еще и надругались.
Третьему котенку живьем отрубили голову и приклеили ее к дереву , пишет волонтер Наталья Александрова.
Эти школьники знают, что все им с рук сходит и нагло заявляют, что никого и ничего не боятся. Я лично ездила с ними общаться. Они смотрят в глаза и с радостью рассказывают подробности своих развлечений .
На следующий день после подписания признательных показаний дети стали отказываться от своих слов . Версия детей изменилась - все произошло случайно, нашли топор, уронили на котов.
Маме старшего мальчика предложили пройти медико-педагогическую комиссию, чтобы поместить ребенка в школу-интернат, рассказала Людмила Савочкина, но мама отказалась, потому что ей неудобно возить туда сына - интернат находится на другом конце города.
Самое главное, что родители не считают преступлением то, что совершили их дети. Эта и подобные трагедии случаются только по одной причине - равнодушие взрослых. Ведь сколько людей видели жестокость детей по отношению к животным и проходили мимо, молчали, боясь сообщить в правоохранительные органы.
В отношении детей поставлен вопрос о возбуждении уголовного дела , но так как они не достигли возраста уголовной ответственности , то в возбуждении дела будет отказано.
В отношении родителей тоже составлены протоколы, но уже об административном правонарушении. Вот только сумма штрафа ничтожно мала - за поощрение жестокости своих детей их мамы и папы заплатят всего 500 рублей (около 7,5 $)
Но самое страшное, что огласка и уголовная статья не остановили маленьких живодеров :
Уже после того, как об издевательстве и убийстве котят стало известно, и с детьми пообщались сотрудники правоохранительных органов и инспекторы ПДН (подразделение по делам несовершеннолетних), рядом с домами снова нашли обезображенные трупы животных, рассказала администратор группы "Помощь животным города Балаково" Людмила Набилкина.
- Тела котят найдены были во дворе дома 1-го микрорайона, этот двор находится в непосредственной близости от того места, где школьники убили трех других котят. Фотографии изуродованных животных в качестве доказательств мы приложили к заявлению в полицию.
Жертвой живодеров мог стать и четвертый котенок (фото). Животное успели спасти прибежавшие к месту казни котят взрослые.
Расправу над котятами дети снимали на видео, а после выложили в "YouTube". Правда, после огласки шокирующий ролик удалили.
-Наши Волонтеры не раз спасали искалеченных котов и собак - рассказала Людмила Набилкина.
Подобные зверства в Балаково, как, и в любом другом городе России происходят не впервые:
* В городе Киров, на улице Северное кольцо были зверски убиты 9 животных - взрослая собака и восемь щенков...
* В Рязанской области: парни связали коту лапы скотчем и привязали к животу мощную петарду . Затем один из парней поджег фитиль. Животное погибло. Третий участник расправы снял все происходившее на видеокамеру...
* В Алтайском крае двое местных жителей в ноябре т.г. на окраине с. Солонешное жестоко из хулиганских побуждений, с применением садистских методов, палками более 20 минут наносили повреждения собаке, привязав домашнее животное к дереву. От полученных травм собака умерла...
* В Калуге Автомобилист по протащил дороге привязанную к его автомобилю собаку. Очевидцы рассказали что "садист на синей" Ниве "тащил на скорости привязанную к машине собаку. Она сначала бежала, а потом упала без сил. При этом на сигналы других автомобилистов водитель не отреагировал и не остановился...
* В Тюменской области семья фермеров пыталась жестоко расправиться с собакой. Они привязали животное к бамперу машины и протащили по дороге два километра. пса чудом удалось спасти. Но и сейчас он находится в тяжелом состоянии. зверство происходило на глазах у местных жителей, в том числе и детей...
* в Рязани: в парке Морской славы неизвестные положили кошку в полиэтиленовый пакет и закопали заживо...
* в Новокузнецке мужчина днем находился в состоянии алкогольного опьянения у себя дома , в квартире также был его 14-летний сын Беспричинно, без какого-либо повода 42 -летний обвиняемый выбросил с балкона собаку, которая жила в их семье около года. в присутствии сына и восьмилетнего мальчика, стоявшего под балконом, дворняжка Лорд упал на землю и травмировался. Тогда обвиняемый заставил сына идти на улицу и принести собаку домой . Затем он, понимая, что животное ранено, скулит и испытывает страдания, вновь выбросил его с балкона. После этого мужчина вышел на улицу и пытался задушить домашнего питомца...

И это далеко не полный список зверств подвергшихся огласке , среди них расчленения, свежевания, калечения, избиения и убийства.
Жить в обществе, зараженным зоофобией и поддерживающим зоофашистов, стало невообразимо тяжело и небезопасно. Наряду с тем, что в обществе присутствует стойкая неприязнь к людям, пытающимся решить проблему бездомных животных, участились случаи нападений и травли этих людей. А те, кто имеет садистские наклонности, всюду открыто и вызывающе их проявляет, пропагандирует. Вызывая поддержку многих:
Жестокость по отношению к животным и, как следствие, к людям, приобрела угрожающие для существования общества масштабы, потому что остаётся абсолютно безнаказанной в связи с пробелом в законодательстве .
Происходят эти трагедии по следующим причинам:
1) Тотальное равнодушие со стороны правительства РФ:
Россия до сих пор не имеет адекватного федерального закона "О защите животных от жестокого обращения" аналогичного законам, принятым во всех цивилизованных странах мира. В котором наказание было бы соразмерно совершённому преступлению.

2) Отсутствие возможности правоохранительных органов привлекать и наказывать преступников:
В положениях действующей ст , 245 Уголовного кодекса РФ состав преступления прописан таким образом, что привлечь к ответственности лиц, совершающих жестокие действия по отношению к животным, даже если животное погибло или сильно покалечено, практически невозможно.

3) Абсолютное равнодушие со стороны общества к преступлениям против животного мира и природы :
Не пропагандируются общепринятые моральные нормы такие как доброта, сострадание, отзывчивость
Не только НЕ наказывается, но и поощряется антизоозащитная деятельность (догхантер/браконьер/живодёр). Масштабы истребления как бродячих, так и домашних животных превышает все возможные пределы. Участились случаи физической расправы над пожилыми зоозащитниками и их питомцами.

4) Нежелание как государства, так и общества видеть в малолетних (не достигших 18- летнего возраста) садистах и убийцах преступников; отсутствие для них, или их родителей, как людей ответственных / не справившихся с воспитанием своих детей, уголовного наказания. Административный штраф в размере 7,5 $ не является наказанием.

По отношению к малолетним садистам из г. Балаково Саратовской области
мы требуем:
1. Провести проверку Министерством Образования, исключить убийц из обычной школы и перевести в спец.школу .
2. Назначить малолетним живодерам принудительное лечение в психиатрической больнице.
3. Поставить малолетних живодеров на учет в отделе по делам несовершеннолетних.
4. Провести проверку органов опеки и попечительства родителей живодеров. Применить меры, совершенно закономерно будет забрать детей у таких родителей.
5. Ужесточить наказание для родителей за жестокое обращение их детей с животными.

Президента и правительство РФ:
Мы убедительно просим пересмотреть диспозицию статьи 245 УК РФ. А также санкции первой и второй части данной статьи . Преступления, описанные в части первой статьи 245 УК РФ, признать имеющими состав средней тяжести и ввести наказание в виде лишения свободы на срок от трёх до пяти лет . Преступления, описанные в части второй статьи 245 УК РФ, признать имеющими тяжкий состав и ввести наказание в виде лишения свободы на срок от пяти до десяти лет.Животные не являются ни субъектами права , ни участниками общественных отношений, в связи с чем на них не может распространяться действие закона.
Исключить из ГК статус вещи для животных. Признать их живыми. Определить статус животного законодательно как живого существа, которому причиняются боль и страдания вследствие издевательства над ним.
1. присоединиться к международной конвенции о защите животных;
2. принять закон о защите животных, разработанный НКО "Центр защиты прав животных" Вита ", как наиболее всеобъемлющий и грамотный вариант проекта закона;
3. активно применять норму закона в части защиты животных (. ст 245 УК РФ (в ужесточенном варианте)) по отношению к тем, кто издевается над животными или оставляет их в условиях , угрожающих здоровью и жизни животного (в дальнейшем понимая особенную социальную опасность таких "людей" для самого общества, ужесточить наказание по этой статье вплоть до реальных сроков заключения..);
4. ввести в УК РФ статью, запрещающую занятие попрошайничеством с использованием животных.
5. ввести программу помощи в стерилизации животных за счет средств , направляемых в данное время на ежедневный отстрел и отравление животных -компаньонов, ставших при "помощи" бывших хозяев бездомными;
6. открыть в каждом городском (районном) поселении приюты для бездомных животных, с обязательным участием в их работе зоозащитных организаций и волонтеров -добровольцев.
7. Прировнять пропаганду убийств животных к экстремизму, а догхантеров/браконьеров/живодёров к террористам по отношению к животному миру.
